Subclass 186 (ENS) Direct Entry Pathway
1 July 2017 Changes – Direct Entry

  • Eligible occupations updated – see https://www.legislation.gov.au/Details/F2017L00851/Download
  • Newly removed occupations include: Equipment Hire Manager; Fleet Manager; Picture Manager; Property Manager; Psychotherapist; Real Estate Agent Principal; Real Estate Agent; Real Estate Agent Representative; Ship’s Engineer, Ship’s Master; Ship’s Officer and University Tutor
  • Caveats (added restrictions/requirements for specific occupations) added to this visa subclass – see https://www.border.gov.au/Trav/Work/Work/Skills-assessment-and-assessing-authorities/skilled-occupations-lists/caveats-on-occupations 
  • High-income English language ability exemption (salaries above $180,000) eliminated for applications lodged on 1 July 2017 or after. **
  • High-income skills assessment exemption (salaries above $180,000) eliminated for applications lodged on 1 July 2017 or after. **
  • Maximum age at time of application reduced to 44 for all applications lodged on or after 1 July 2017 unless exempted
  • Training benchmark requirements updated, see https://www.legislation.gov.au/Details/F2017L00796 – Changes to training include further limitations to what training funds can qualify for Benchmark A contributions and further limitations as to what training expenses can qualify for Benchmark B
  • Applicant must work as a paid employee under the nominator’s direct control
  • Nominator must provide evidence of a “genuine need” for the nominated position

Subclass 186 (ENS) Temporary Residence Transition Pathway
1 July 2017 Changes – TRT

  • Eligible occupations updated – see https://www.legislation.gov.au/Details/F2017L00851/Download
  • High-income English language ability exemption (salaries above $180,000) eliminated for applications lodged on 1 July 2017 or after. **
  • IELTS 6 (Competent English) or equivalent now required at time of application
  • Maximum age at time of application remains: must be 49 years of age or below at time of application but will fall to 44 years or below at time of application on 1 March 2018
  • Applicant must work as a paid employee under the nominator’s direct control
  • Nominator must provide evidence of a “genuine need” for the nominated position

 (**) – The issue of these exemption removals applying to applications lodged prior to 1 July 2017 as originally announced was reviewed by DIBP and on 12 July 2017 DIBP issued a press release stating that they do not intend to enforce the exemption removals for applications lodged prior to 1 July 2017.
